Terms of service
These General Sales Terms and Conditions (hereinafter the “T&C”) regulate the sale of products and, consequently, are applicable to the services provided through the Website in which the company Tailedecor.com, Lda, (NIPC 516583573, headquartered in Parque Industrial de Viadores, lote 6, 3050-481 Pampilhosa, Portugal) acts as a seller (hereinafter referred to as “Seller”).
1. OBJECT
The Seller undertakes to transfer the goods to the Buyer and the Buyer undertakes to receive the goods and to make the payment accordingly, and in the precise terms, with (and under) the conditions stipulated herein.
2. INFORMATION RELATED TO THE GOODS
2.1 Information on the range and prices of the goods sold through the Seller's Website is provided on it.
2.2. All orders are subject to the Seller's availability to deliver/sell the goods that the Buyer intends to purchase.
3. PLACING THE ORDER
The Buyer formulates its orders through the Seller's Website in the precise formal and functional terms provided therein.
4. PRICE
All prices shown on the Website include VAT and exclude shipping costs. The total value of the order, including the final price of the goods and shipping costs, is fixed in the Buyer's Shopping Cart.
5. PAYMENT
The Buyer will pay the Seller in advance 100% of the total amount due, using one of the following payment methods: credit card or PayPal. Subsequently, the goods will be shipped by the Seller to the Buyer.
6. DELIVERY
6.1 Once the receipt of payment has been confirmed, the goods ordered by the Buyer are delivered to the address specified by the Buyer when placing the order.
6.2 The estimated delivery time is up to 10 business days for mainland Portugal and up to 15 business days for the rest of European Union. During festive periods, delivery times may be subject to changes.
6.3 The title to the goods and the risk of any damages arising therefrom are transferred to the Buyer upon completion of delivery, ie at the time such goods are delivered by the Seller to the specified address.
6.4 Goods are delivered to the address specified in the respective order, provided it is accessible by the carrier and always to the ground floor.
6.5 Once the goods have been delivered, the Buyer visually inspects them. If any damage is found in the packaging, the Buyer describes this on the delivery note. If defective goods are detected, the Buyer, within 3 (three) working days, informs the Seller's Customer Service about it, providing a copy of the delivery note and photos of all the defective goods as they were delivered. There is no need to return the defective goods to the shipping company.
7. RESPONSIBILITY
7.1 The Seller will reimburse the cost of goods damaged or lost in transit, as well as prorated shipping charges, or replace any goods damaged or lost in transit free of charge, provided that:
7.1.1 The Buyer provides written notification of such damage or loss of goods within 72 hours of delivery.
7.1.2 The Buyer shall prepare and provide the Seller with a copy of a document confirming receipt of the Goods, including a description of any visible damages, along with photographs of all damaged Goods.
8. CANCELLATION & RETURNS
8.1 The Buyer has the right to cancel the order, provided it has not yet been dispatched.
8.2 The Buyer has the right to return the Goods at any time and for any reason within 14 calendar days of receipt. This right shall expire after this period.
8.3 The Buyer shall be liable for any reduction in the value of the Goods resulting from incorrect, negligent, or damaging handling, taking into account their respective characteristics and technical specifications.
8.4 Given that the Goods are delivered via specific means of transport, only the cost of the Goods will be refunded in the event of a return. Shipping costs are non-refundable. Should the Buyer decide to return the delivered Goods, the transport of the Goods back to our warehouse shall be arranged and paid for by the Buyer.
9. DELAY OR FAILURE OF EXECUTION
9.1 Seller shall not be liable to Buyer if it is prevented or delayed in performing any of its obligations to Buyer due to any cause beyond its reasonable control, including (without limitation): explosion, flood, fire or accident; war or civil disturbance; strike, labour action or work interruptions; any form of government intervention; an act or omission of a third party; failure of Seller's supplier(s); Buyer's failure to provide Seller with a correct delivery address or to inform Seller of any change to the address provided.
9.2 The Seller will inform the Buyer of any unforeseen or force majeure event within seven days of the respective occurrence, and will arrange a new delivery date with the Buyer once the event in question has ended. If these circumstances or events continue beyond a two-week period, the Buyer shall have the right to cancel the order.
10. COLLECTION METHOD AND PURPOSE OF PERSONAL DATA
Customers' personal data is collected and processed by the Seller solely for purposes related to the use of this site and the services offered. However, personal data may also be used for other processing operations within the limits of these applications and always within the scope of the express authorisation granted by the customer/user. The Seller collects personal data from its customers exclusively by electronic means. Customers' personal data is stored in a way that allows the Seller to identify the customer for as long as strictly necessary. Except as expressly provided in this document, all else complies with applicable laws. Any changes to customers' personal data should be communicated to the Seller, in the interest of both parties, by emailing marketing@tailedecor.com, to ensure that personal data is always up-to-date. Unless otherwise stated, personal data will not be disclosed to third parties for unauthorised purposes or without the customer’s explicit consent.
11. RIGHT OF ACCESS TO PERSONAL DATA AND OTHER RIGHTS
The user/customer has the right to obtain confirmation from the Seller at any time that their data is being processed, even if not registered on the site, and to receive that data in a clear and comprehensive format. The user/customer has the right to be informed by the Seller about the source of the data, the purposes and methods of processing, the intent behind the electronic processing of such data, and information regarding external entities and the names of persons or categories of entities to whom their personal data may be disclosed or who may access it. The user/customer has the right to obtain:
a) The update, rectification, or completion of their personal data;
b) The deletion (right to erasure), anonymisation, or blocking of their personal data if it is being processed in violation of the law, including when data retention is unnecessary for the purposes for which it was collected and processed;
c) Confirmation that the actions in points (a) and (b) have been communicated to those to whom the data was disclosed, except where this proves impossible or exceeds the rights invoked;
d) The portability of their personal data, held by the Seller, to entities they designate;
e) The right to lodge complaints with the National Data Protection Commission (CNPD) regarding any perceived violations of their rights as defined herein. The user/customer may freely exercise their rights at any time, provided it is done in compliance with applicable laws and regulations, by sending a request to the Seller via email at marketing@tailedecor.com.
12. ALTERNATIVE DISPUTE RESOLUTION
Under the terms and for the purposes of article 18 of Law no. 144/2015, of 8 September, Tailedecor.com, Lda. informs that in the event of a dispute the Buyer/consumer has the possibility of resorting to Alternative Dispute Resolution entities, namely the CNIACC - Centro Nacional de Informação e Arbitragem de Conflitos de Consumo, Faculdade de Direito da Universidade Nova de Lisboa, Campus de Campolide, 1099-032 Lisboa.
13. CHANGES TO THE T&C
13.1. We reserve the right to modify these T&C when this proves to be functionally and commercially relevant, at our sole discretion, and therefore users must periodically check the T&C in force. Whenever we make a change to the T&C, we publicize it or notify, by the most effective means available, the users of our website.
13.2. In the event of the aforementioned changes in the T&C of this website, the fact that you continue to resort and use it configures and constitutes your acceptance of the new T&C that will come into force from the moment of their implementation.
